AVISO IMPORTANTE / IMPORTANT NOTICE
1. Purpose and contractual relationship
These BChat Terms and Communications Notice (the “BChat Terms”) govern access to and use of BChat by Bliim users. They form part of the contractual relationship between the user and BLIIM GLOBAL LLC and supplement the Bliim General Terms of Use, the Acceptable Use and Prohibited/Restricted Activities Policy, and the Global Privacy Policy and Notice.
BChat is activated as a specific messaging relationship. Creation of a Bliim Account does not by itself constitute acceptance of these BChat Terms or enable messaging. Where BChat is available to the user, acceptance must occur before the first message or other act of publishing content.
2. What BChat is
BChat is a technology communications feature integrated into the Bliim Platform. Depending on the approved configuration, it may allow identified users to exchange messages and other content, receive BChat-related communications or access additional features expressly enabled by Bliim.
BChat Social, BChat Support and System communications are separate categories. Social messages between users are not treated as support tickets; support messages may be handled by authorised personnel; and necessary system communications are separated from promotional communications.
3. Eligibility and access
To use BChat, the user must maintain a valid Bliim Account, satisfy applicable age and legal-capacity requirements, and not be subject to a restriction preventing use of the feature.
Bliim may limit BChat by country, age, account status, risk, security, abuse, App Store or Google Play requirements, legal obligations or technical availability. A visible feature may be disabled or unavailable to a particular user.
4. Acceptance before the first message
Before the first message, the user must have access to these BChat Terms, the applicable privacy and security notice and the Community and Safety Rules. Where law or contractual design requires, acceptance will be affirmative and recorded in a verifiable manner.
The acceptance record may retain, among other elements, user ID, document version, language, date and time, country or jurisdiction, app/build version and acceptance method.
5. Identity, profiles and contacts
BChat may display a name, identifier, profile image, status or other information the user has chosen to make visible under the applicable settings. The user must not impersonate another person, falsify an identity, or misleadingly present an affiliation, authority or relationship with Bliim or any third party.
BChat is not designed as a random or anonymous chat service. Any feature enabling discovery, random matching, substantive anonymity or interaction with strangers requires separate approval before enablement.
6. User Content
The user retains the rights they hold in messages, files, images and other content submitted to BChat (“User Content”).
The user grants Bliim only the rights reasonably necessary to host, transmit, deliver, protect, moderate, investigate abuse and operate BChat under these Terms and the Privacy Policy.
The user represents that they have the rights, permissions or legitimate basis necessary to share User Content and that it does not infringe third-party intellectual-property, privacy, confidentiality, image or other rights.
7. Prohibited conduct
The user must not use BChat to carry out, promote, facilitate or attempt conduct that violates law, these Terms, the Acceptable Use Policy or the Community and Safety Rules.
Prohibited conduct includes fraud, phishing, social engineering, malware, impersonation, extortion, threats, harassment, doxxing, sexual exploitation, child sexual abuse material, non-consensual intimate content, unlawful hate, sale or promotion of illegal goods or services, sanctions evasion, money laundering, illicit financing, manipulation of users, spam, unauthorised scraping and attempts to circumvent security, reporting or blocking controls.
8. Spam, marketing and solicitation
BChat must not be used for unsolicited bulk campaigns, deceptive solicitation, pyramid schemes, unlawful promotions or commercial communications that violate law or the recipient’s preferences.
Promotional communications sent by Bliim are managed separately from necessary service messages. Acceptance of BChat does not constitute general marketing consent.
9. Credentials, secrets and sensitive information
The user must not share passwords, authentication codes, PINs, private keys, seed phrases, complete bank credentials or other security secrets through BChat. Bliim will never require a user to provide a seed phrase or private key to enable a product.
Before sharing personal data or confidential information about another person, the user should consider whether they are authorised to do so and whether the channel is appropriate for that information.
10. Security, encryption and confidentiality
Bliim will apply security measures appropriate to the technical architecture implemented and the risks of BChat. The presence of encryption in transit or at rest must not automatically be interpreted as end-to-end encryption.
The user must not assume that BChat is end-to-end encrypted, that Bliim or its providers have no technical access, that messages disappear irreversibly or that anonymity exists unless the BChat interface expressly states so and the feature has been technically validated by Bliim.
No public claim regarding encryption, privacy, anonymity, retention or access overrides the actual technical architecture.
11. Message delivery, status and availability
A message displayed as sent, delivered, received or read reflects the state available in the interface and is not a guarantee of receipt, preservation or reading by a particular person.
BChat may experience delay, failure, duplication, interruption, loss of connectivity or unavailability. The user should not rely on BChat as the sole means for urgent communications, emergencies, formal legal notice or critical financial instructions unless Bliim expressly states that a feature is designed for that purpose.
12. Reporting, blocking and safety controls
BChat will provide reasonable mechanisms to report content or users and to block users in individual-interaction features when BChat is enabled.
Bliim may request additional information to investigate a report and may apply warnings, restrictions, feature blocks, suspension or closure according to severity, recurrence, available evidence and applicable law.
Abuse of reporting tools, including fraudulent reports or reports intended to harass others, may itself constitute a breach.
13. Moderation and content measures
Bliim may use human, technical or automated controls to detect, prevent or respond to fraud, abuse, prohibited content, malware, spam, security risks or violations of these Terms. Bliim does not promise prior review of every message and does not assume a general obligation to monitor all communications.
Where Bliim removes, restricts or limits content or an account, it will take measures reasonably proportionate to the risk, legal obligation, user rights and service architecture. Where applicable law requires reasons, appeal or a complaint mechanism, those will be provided.
14. Illegal content and removal notices
Where Bliim is subject to hosting, platform or intermediary obligations relating to user content, it may provide mechanisms to notify allegedly illegal content and submit information necessary to identify and assess it.
Bliim may preserve, restrict or remove content where there is a valid legal duty, competent order, serious security risk, breach of these Terms or another legitimate basis under applicable law. Measures are applied without promising outcomes or timeframes beyond those legally required.
15. Intellectual property and third-party claims
The user must not use BChat to distribute content infringing copyright, trade marks, trade secrets or other intellectual-property rights.
Bliim may act on sufficiently substantiated notices, request further information, restrict content or accounts and apply repeat-infringer measures where appropriate. Nothing in these Terms makes Bliim the owner of User Content.
16. Privacy, metadata and providers
Processing of personal data relating to BChat is governed by the Bliim Global Privacy Policy and Notice and the BChat Privacy and Security Notice contained in this document.
Depending on the architecture, BChat may process content, sender and recipient identifiers, timestamps, delivery/read states, device/session data, abuse reports, security data and other metadata reasonably necessary to operate, protect and audit the service.
Bliim may use technology providers for infrastructure, storage, delivery, security or moderation. The role, data and transfers of each provider are governed by the applicable architecture and privacy documentation.
17. Access by support and authorised personnel
Social messages and support messages are managed as separate channels. Where the user opens a support case, the user may communicate with authorised personnel and information provided to the case may be retained as support, security, complaint or compliance evidence.
Where the technical architecture permits access to content or metadata, Bliim will limit that access to authorised personnel or providers, defined purposes and appropriate security controls. Bliim will not claim that it lacks technical access where that statement has not been validated.
18. Retention, deletion and copies
Retention of content, metadata, reports, support and security records depends on purpose, architecture, jurisdiction, legal obligations, investigations, legal holds and the applicable retention policy.
Deleting a message or account does not guarantee immediate deletion of all copies. The recipient may retain a copy; backups may exist for limited periods; and certain records may be retained where necessary for security, abuse, complaints, audit, legal obligations or defence of rights.
Bliim will not describe a feature as “disappearing messages” or irreversible deletion unless the technical behaviour has been tested and accurately described.
19. Government requests and preservation
Bliim will respond to orders, requests or demands from authorities only in accordance with applicable law, the legal scope of the request and information Bliim has or can lawfully obtain.
Bliim may preserve records where required by a valid legal duty or legal hold. Where law permits, Bliim may notify the user of a request; it will not do so where prohibited, where notification could jeopardise an investigation or where notice is legally restricted.
20. Payments and financial products through BChat
BChat does not itself authorise payments, transfers, purchases or conversions of assets, opening of accounts, card issuance or other financial transactions.
Any financial action initiated from a conversation must continue through the authorised Bliim or partner financial flow.
Before confirmation, the user will receive the terms, authentication and disclosures required for that product. A message from another user never substitutes the official confirmation of a transaction.
21. Voice, video, bots and additional features
Voice, video, calls, bots, agents, inline payments, public groups, channels, discoverability or other capabilities are not part of BChat merely because the interface may anticipate them.
Each additional feature may require legal, telecom, privacy, security, moderation, age or partner-specific review. Until Bliim expressly enables it, the user should not assume it is available or authorised.
22. Minors and vulnerable users
BChat is not designed as a service directed to children. The minimum age for use depends on the Bliim Account, jurisdiction and enabled features.
Bliim may apply age gates, contact restrictions, privacy by default, blocking, enhanced moderation or other measures where necessary to protect minors or vulnerable users. Grooming, sexual exploitation, sextortion, harassment or solicitation of sexual material from minors is strictly prohibited.
23. Suspension, restriction and closure
Bliim may restrict, suspend or close BChat where there is a breach of these Terms, abuse, fraud, security risk, legal duty, competent order, sanctions, repeat misconduct, risk to others or a reasonable need to protect the Platform.
Where legally possible and reasonable, Bliim will inform the user of the measure and available steps. Information that is legally restricted or could compromise controls, investigations or security will not be disclosed.
24. User responsibility
The user is responsible for content they send and for the people with whom they choose to communicate. They should independently verify any unusual request for money, codes, credentials, account changes, payment instructions or purported contact from Bliim.
Bliim does not automatically control or endorse claims, offers, links, identities or content sent by other users. Presence of a user on BChat does not constitute commercial, financial, professional or reputational validation by Bliim.
25. Limitations and mandatory rights
BChat is provided subject to technical availability and the approved scope. To the extent permitted by law, Bliim does not guarantee uninterrupted availability, perfect delivery, absence of offensive content, indefinite preservation of messages or detection of every abuse before harm occurs.
Nothing in these Terms excludes liability or rights that cannot be excluded by law, or limits mandatory consumer, privacy, security, freedom-of-expression or due-process rights that apply.
26. Jurisdictions and the Digital Services Act
Content and messaging rules depend on country and the actual nature of BChat. In the European Economic Area, if BChat qualifies as an intermediary service, hosting service or online platform under the Digital Services Act, Bliim will apply the obligations corresponding to its classification, size and function, including terms transparency, notice-and-action, reasons and redress where required.
The existence of private messaging does not automatically mean that all of BChat is an “online platform” for DSA purposes. Classification depends on the actual manner in which content is stored and, where applicable, disseminated.
27. Changes to BChat and these Terms
Bliim may modify BChat or these Terms to reflect changes in law, security, technology, provider, moderation, product or risk. Material changes will be subject to the applicable change-control process.
Where a change requires renewed acceptance or notice, Bliim will present it before the user continues to use the affected feature. Historical versions and acceptance events may be retained as evidence.
28. Contact and complaints
For BChat support: [email protected]. For legal, privacy or formal requests: [email protected]. Contact number: +1 302-440-5997.
Abuse reports should preferably be initiated through the Report function available in BChat so that relevant context and the case identifier can be preserved. Privacy, security or illegal-content complaints may also use any specific channels Bliim publishes for the applicable jurisdiction.
29. Effective date
These BChat Terms are effective from 8 September 2026 and remain in force until replaced by a later version published by Bliim.
Publication of these Terms does not mean that BChat is available to every user, country or configuration. The feature will only be enabled where Bliim has completed the applicable security, privacy, content, eligibility, moderation and jurisdiction controls.
ANNEX I — BCHAT PRIVACY AND SECURITY NOTICE
1. Data BChat may process
Depending on the enabled architecture, BChat may process message and file content, user identifiers, participants, dates and times, delivery or read states, device and session data, reports, blocks, security signals, support data and other metadata necessary to operate and protect the feature.
2. Purposes
Data may be used to deliver messages, maintain sessions, enable reporting and blocking, prevent spam and fraud, investigate abuse, provide support, protect security, retain evidence and meet legal obligations. Bliim does not describe BChat as end-to-end encrypted unless the feature is expressly shown in the interface and formally technically validated. The actual treatment of content, keys, metadata and access is governed by the approved production architecture.
4. Retention and deletion
Retention periods depend on data category, purpose, backups, security, reports, support, legal holds and applicable law. Deletion by a user does not remove copies already held by the recipient or records that may legitimately need to be retained.
5. Providers and transfers
Bliim may use technology providers for infrastructure, delivery, storage, security or moderation. Applicable data and locations are governed by the Global Privacy Policy, vendor contracts and required international-transfer mechanisms.
